Hosts and their guests publish their own content on Hostbnb: guide text, photographs, recommendations, tips. We do not review it before it goes up. When something on the service infringes your rights or breaks the law, this page is how you tell us, and it is the fastest route — a report sent here reaches the people who can act on it.
Reporting a copyright infringement
To report material you own the copyright in, send a written notice to our designated agent containing all six of the following. US law requires each one, and a notice missing any of them may not be legally effective:
- 1Your physical or electronic signature, as the owner or someone authorised to act for them.
- 2Identification of the copyrighted work you say has been infringed — or, for several works on one site, a representative list.
- 3Identification of the infringing material, with the exact URL so we can find it. "Somewhere on your site" is not enough for us to act on.
- 4Your address, telephone number and email address.
- 5A statement that you believe in good faith that the use is not authorised by the owner, its agent, or the law.
- 6A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act for the owner.

A false notice has consequences
Under 17 U.S.C. §512(f), anyone who knowingly misrepresents that material is infringing is liable for the damages and legal costs that misrepresentation causes. If you are not sure you hold the rights, or whether the use might be fair, take advice before sending a notice.
We act on valid notices promptly: we remove or disable the material, tell the person who published it, and pass on your notice so they can respond.
Counter-notice
If your content was removed and you believe that was a mistake or a misidentification, you can send a counter-notice to the same address with:
- 1Your physical or electronic signature.
- 2Identification of what was removed and where it appeared before removal.
- 3A statement, under penalty of perjury, that you believe in good faith it was removed as a result of a mistake or misidentification.
- 4Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal court for your district — or, if you are outside the United States, of any district where we may be found — and that you will accept service of process from the person who filed the original notice.
We pass your counter-notice to the original complainant. Unless they tell us within 10 to 14 business days that they have filed court proceedings, we may restore the material.
Repeat infringers
We keep a record of notices we act on, and we terminate the accounts of hosts who repeatedly infringe. That is both our policy and a condition of the safe harbour the law gives us.
Reporting other illegal content
This is our notice-and-action mechanism under Article 16 of the EU Digital Services Act. Anyone — you do not need an account — can report content they consider illegal by writing to abuse@hostbnb.example.com with:
- The exact URL of the content.
- An explanation of why you consider it illegal, and under which law.
- Your name and email address, unless the report concerns an offence against a child or another offence where you would rather stay anonymous.
- A statement that you believe in good faith that the report is accurate and complete.
We confirm receipt without undue delay, decide in a timely, diligent and non-arbitrary way, and tell you what we decided and how to appeal it. Decisions are made by people, not by an automated filter. Where content appears to involve a threat to someone's life or safety, we act immediately and contact the authorities.
If your content was removed
We tell you what was removed, the legal or policy ground we relied on, whether the decision came from a report or our own review, and how to contest it — a statement of reasons, as Article 17 of the DSA requires.
To contest one, reply to that notice or write to legal@hostbnb.example.com within six months. A person who was not involved in the original decision reviews it. You keep any right you have to go to court, or to an out-of-court dispute settlement body under Article 21 of the DSA.
Misuse
We suspend, after a warning, both accounts that repeatedly publish illegal content and reporters who repeatedly file obviously unfounded notices. Both waste the same review capacity.
Trademarks and other rights
For trademark, publicity, privacy or defamation complaints, write to legal@hostbnb.example.com with the URL, the right you hold, and why the use infringes it. For a request to remove personal information about you, the Privacy Policy sets out a faster route.
